A BILL to amend article four, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section thirteen,
relating to authorizing the county board of education to
transfer a contracted county superintendent to a professional
educator position within the county school system and how it
affects his or her rate of pay.
Be it enacted by the Legislature of West Virginia:
That article four, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
thirteen, to read as follows:
ARTICLE 4. COUNTY SUPERINTENDENT OF SCHOOLS.
§
18-4-13. Transfer of contracted county superintendent.

The board may, upon sixty days notice, with notification and a vote, transfer a contracted superintendent of schools to a
professional educator position within the county school system at
a rate commensurate to his or her contracted salary: Provided,
however, That at the expiration date of his or her contract, he or
she shall be paid in accordance with the appropriate state or
county salary schedule: Provided, however, That if the contracted
superintendent does not continue employment within the county
school system, then the contract of the contracted superintendent
shall be terminated.

NOTE: The purpose of this bill is to authorize the county
board of education to transfer a contracted superintendent to a
professional educator position within the county school system at
the same rate of pay under the existing contract until his or her
contract ends, then the rate of pay will be at the appropriate
salary schedule; and provides that if the contracted superintendent
does not continue employment within the county system, then his or
her contract will terminate.
